Welcome to Alma. By using our app, you agree to these Terms of Service. Please read them carefully.

1. Account Usage

Account Sharing:

You may share your Alma account with one other person (e.g., a study partner or family member). However, each person may only have one Alma account.

Device Limits:

• Maximum of 5 devices per account
• Maximum of 1 account per person

If you need to use Alma on a new device after reaching the limit, please contact support to remove an old device from your account.

Account Security:

You are responsible for maintaining the security of your account. We take steps to prevent unauthorized access and abuse.

2. Fair Use Policy

Alma provides features subject to reasonable usage limits. While we offer generous limits, our service is not unlimited.

Free Tier:

The free tier includes usage limits on features such as photo uploads, podcast generation, and AI queries. These limits are designed to provide a great experience while keeping the service sustainable.

Plus Subscription:

Plus subscribers receive significantly higher limits, but these are still subject to fair use. "Unlimited" features mean you can use them extensively for normal personal study purposes, but not for:

• Commercial use or resale of content
• Automated or bulk processing
• Excessive usage that impacts service quality for others
• Any use that violates these Terms

Abuse Prevention:

We reserve the right to throttle, limit, or suspend accounts that exhibit:

• Abnormally high usage patterns
• Automated or scripted access
• Sharing accounts across multiple users
• Any activity that could harm our service or other users

3. AI-Generated Content and Limitations

AI Assistance:

Alma uses artificial intelligence to help process and summarize your study materials. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

Your Responsibility:

• Always verify important information from original sources
• Use AI-generated summaries as study aids, not as sole learning resources
• We are not responsible for academic outcomes, test results, or decisions made based on AI-generated content

Alma is a study tool to assist your learning, not a replacement for studying original materials or attending classes.

4. Content and Intellectual Property

Your Content:

You retain full ownership of all content you upload to Alma, including notes, audio recordings, photos, and documents. By using Alma, you grant us a limited license to store, process, and analyze your content on our servers solely to provide the service to you. We will not use your content for any other purpose.

Acceptable Use:

You may only upload content that you have the right to use. Do not upload:

• Copyrighted material you don't have permission to use
• Illegal, harmful, or offensive content
• Content that violates others' privacy or rights
• Zero Tolerance: We have a zero-tolerance policy for objectionable content. We reserve the right to immediately remove content and ban users who post hate speech, pornography, bullying, or other offensive material without prior notice.

Alma's Intellectual Property:

The Alma app, including its design, features, and technology, is owned by Alma and protected by intellectual property laws.

5. Subscriptions and Payments

Plus Subscription:

• Subscriptions are billed monthly or annually through Apple's App Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• Manage your subscription in the Alma app Settings page

Refunds:

For refund requests, please contact us at support@almaapp.xyz. We handle refunds on a case-by-case basis.

Changes to Pricing:

We may change subscription prices with advance notice. Price changes will not affect your current billing period.

6. Service Availability

We strive to keep Alma available and reliable, but we do not guarantee:

• Uninterrupted or error-free service
• That all features will be available at all times
• Specific uptime or performance levels

We may modify, suspend, or discontinue any part of Alma at any time with reasonable notice.

7. Account Suspension and Termination

By You:

You can delete your account and all associated data instantly at any time from the bottom of the Settings screen in the app. Upon deletion, your data will be permanently removed.

By Us:

We reserve the right to suspend, limit, or terminate accounts that:

• Violate these Terms of Service
• Abuse free tier credits or features
• Engage in fraudulent behavior or account manipulation
• Spam our database or servers
• Exceed fair use limits despite warnings
• Create multiple accounts to circumvent usage limits
• Pose a security or performance risk to Alma or other users

We will provide notice and opportunity to remedy violations when possible, but reserve the right to suspend or terminate immediately in cases of serious abuse or security threats. Subscriptions are non-refundable in cases of termination for Terms violations.

8. Limitation of Liability

Alma is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months
• We are not responsible for lost data, though we make reasonable efforts to protect it

9. Privacy

Your use of Alma is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• Updating the "Last Updated" date
• Providing notice through the app

Continued use of Alma after changes constitutes acceptance of the updated Terms.

12. Apple Device Terms

If you are accessing Alma on an iOS device, you acknowledge and agree that:

• Parties: This Agreement is between you and Alma only, not with Apple. Alma, not Apple, is solely responsible for the App and its content.
• Maintenance: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Claims: Alma, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, legal compliance claims, and intellectual property infringement claims.
• Third-Party Beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
